1. Who we are
OpenEngReview is operated by EYO Consulting LLC-FZ trading as OpenEng, Licence No. 2419380.01, of 6th Floor Meydan Grandstand, Meydan Road, Nad Al Sheba, Dubai, UAE (“OpenEng”, “we”, “us”). Contact: info@openeng.co. By creating an account, uploading a document, or using the service you agree to these Terms.
2. The service
OpenEngReview is an AI-assisted decision-support tool that reviews port, coastal and marine engineering design submissions (calculations, reports and spreadsheets) against a governing code you select, and returns clause-referenced, severity-rated, advisory findings to your private dashboard.
3. Decision-support only — not a substitute for independent checking
The service supports, and does not replace, the professional judgement of a competent engineer. Findings are advisory only. The service does not certify, approve or sign off any design, and is not a substitute for your own review, independent checking, or any statutory or contractual verification. The responsible engineer remains fully accountable for the design.
4. No guarantee of accuracy
Outputs are generated by automated AI analysis and may be incomplete or incorrect. We do not warrant that any finding (or the absence of a finding) is accurate, complete or fit for any purpose. You must independently verify everything before relying on it.
5. Eligibility, B2B use and accounts
The service is provided strictly as a business-to-business (B2B) platform. You warrant that you are using it for professional or commercial purposes and not as an individual consumer, and (to the extent permitted by law) you agree that consumer-protection rights that would otherwise apply to a consumer do not apply. It is for use by competent engineers and engineering organisations; you must be at least 18. You are responsible for activity under your account and for keeping your sign-in secure.
6. Your responsibilities and warranties
Each time you upload, you confirm that: (a) you have the right and all necessary permissions to upload the document and have it processed as described; (b) the document contains no confidential, third-party proprietary, personal, or export-controlled information; (c) the information you provide is accurate; and (d) your use complies with all applicable laws and any duties you owe to clients or employers.
7. Licence you grant us
You retain ownership of the documents you upload. You grant OpenEng a limited licence to store and process your uploads to provide the service. Separately, and only if you tick the optional consent at upload, you grant a licence to use a de-identified version of uploaded content to improve the tool. That improvement consent is optional and may be declined or withdrawn at any time without affecting your access to the core review service.
8. Our intellectual property
The platform, software, prompts, model configuration, and the format and methodology of the reviews are owned by OpenEng or its licensors. We grant you a limited, revocable, non-transferable right to use the service for your internal professional purposes.
9. Acceptable use
You must not misuse the service, including: uploading malware; attempting to breach security or access other users’ data; reverse-engineering the service; using it to build a competing product; or uploading content you are not permitted to share.
10. Subscription, fees and renewal
Access is provided on a monthly or annual subscription (per seat or per organisation), or via pay-per-review credit packs, at the fees shown at checkout. Subscriptions renew automatically until cancelled. Fees are payable in advance and are non-refundable except as required by law. You may cancel at any time effective at the end of the current billing period via your account or the Stripe customer portal; cancellation stops future renewals but does not refund the current period. We may change fees on 30 days’ notice, effective from your next renewal. We may suspend access for non-payment after reasonable notice. Taxes (including VAT) are your responsibility where applicable. Beta pricing is provisional and may change.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided “as is” and “as available” and we exclude all implied warranties. To the maximum extent permitted by law, OpenEng is not liable for any loss arising from use of, or reliance on, the service or its outputs, including any design error, omission, delay, inaccuracy, or loss of profit, data or goodwill. Our total aggregate liability for all claims is limited to the LESSER of (a) the fees you paid in the 12 months before the claim, or (b) USD 500. Nothing limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud).
12. Indemnity
You agree to indemnify OpenEng against claims arising from your breach of these Terms or from your uploading or use of content you were not permitted to share.
13. Suspension and termination
We may suspend or terminate access for breach or to protect the service. You may stop using the service and request deletion of your data at any time (see the Privacy Policy).
14. Changes
We may update the service and these Terms. Material changes will be notified, and the version and date shown. Continued use after changes means acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the DIFC (Dubai International Financial Centre), and disputes are subject to the DIFC Courts. This does not remove data-protection rights you have under the law of your own country.
